Terms of service
Who we are
These terms are between you and ABCD Group LLC, doing business as CardByMail (“we”, “us”).
ABCD Group LLC is a Florida limited liability company. You can reach us at hi@cardbymail.com.
What CardByMail is
CardByMail is a physical subscription. Once a month we mail one card with one unexpected thing to do on it. You don’t choose the card, and you don’t have to do what it says.
You can subscribe monthly or yearly, or buy a gift for someone else to redeem. The sections below cover each of these.
Agreeing to these terms
By creating an account, subscribing, buying a gift or redeeming one, you agree to these terms and acknowledge the Privacy notice. If you don’t agree, please don’t use CardByMail.
You must be at least 18 years old to create or hold an account, or to buy.
Your account
You sign in with an email address and a password. Sign-in is handled by Supabase Auth, which also sends the emails that confirm your address and reset your password. This site sends no other email, though Stripe may send you receipts.
Keep your password private, and tell us if you think someone else has got into your account.
Your cards go to the mailing address on your account. Please keep it correct: you can edit it on your account page.
Plans, payment and renewal
There are two plans, monthly and yearly. You see the price on Stripe’s checkout page, and nothing is charged until you confirm there. The price you pay is the one shown on that page.
Payments are taken by Stripe. Your card or bank details go to Stripe and never reach us.
A subscription renews automatically at the end of each billing period, monthly or yearly, and charges the payment method on file. See “Cancelling and refunds” for how to stop it.
If a renewal payment fails, your plan stays active while the payment is retried. Your account page says when a payment didn’t go through and lets you update your payment method.
We automatically retry a failed payment for a limited period. If the payment still fails at the end of that period, the subscription is cancelled. On the monthly plan, the retry period does not run past the next billing date. On the yearly plan, the retry period is also limited; it is set in our payment settings.
Cancelling and refunds
Monthly and yearly subscriptions renew automatically, and keep renewing, until you cancel. If you cancel, the next billing cycle is not charged.
To cancel, sign in, open your account page and choose “manage billing”. That opens Stripe’s billing page, where you can cancel, update your payment method and see your invoices.
Cancelling takes effect at the end of the period you have already paid for. Your plan stays active until then, and your account page shows the date it ends.
Refunds
Payments are generally non-refundable, and we don’t offer refunds as a matter of course. This applies to subscription payments and to gift purchases.
If you think an exception is warranted, email hi@cardbymail.com. We decide any exception case by case, at our discretion.
Nothing in this section limits any refund that applicable law requires.
Gifts
A gift is a one-time payment for twelve months of CardByMail. It doesn’t renew.
Buying a gift gives you a single-use code and a link. Whoever has the code can redeem it, so keep it private until you hand it over. A code works once. You can make a new code from the page that shows it or from your account, which cancels the old code.
To redeem a gift you need an account. If the person already has a gift running, the new one starts when that one ends. If they have a subscription, the gift runs alongside it and doesn’t pause or extend it.
When you buy a gift you can add the recipient’s first name, which only you see, and a note of up to 280 characters, which is shown to whoever redeems the gift.
The person who redeems a gift gives their own mailing address and answers. The person who bought the gift can’t see them.
If you buy a gift without signing in, the page that shows the code keeps working in the same browser for 30 days. If you were signed in, the code stays listed under “Gifts you’ve given” on your account. If you lose a code, email us: whether we can recover it depends on whether we can verify the purchase.
If a gift’s payment is refunded in full, or lost in a payment dispute, before the code is redeemed, the code stops working. While a dispute is open the code is on hold, and if the dispute is resolved in our favour it works again. If a gift has already been redeemed when its payment is refunded or disputed, the gift is not cancelled automatically; it is flagged for our review.
Expiry and cash value. We don’t set an expiration date on gift codes, except where applicable law requires or permits one. A redeemed gift gives the recipient twelve months of cards from the day it is redeemed. A gift has no cash value and can’t be redeemed for cash, except where the law requires.
Delivery
Cards are mailed to the address on your account. Delivery area: United States. Cards are not mailed anywhere else.
Delivery times. Delivery can happen at any time within 30 days of the start of your subscription. The first card normally ships after about 7 days. For a gift, the subscription starts when the recipient redeems the gift.
Disclaimers and liability
As is. To the fullest extent permitted by law, CardByMail, the cards and the service are provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. We give no assurance of any outcome, experience or delivery date beyond what is stated under Delivery.
Doing what a card suggests. A card is an invitation, not an instruction, and doing what it suggests is optional. To the fullest extent permitted by law, you are responsible for deciding whether and how to do anything a card suggests. You must use your own judgement: follow the law, stay within your abilities, health and budget, respect the rules of any place and the rights and wishes of any person involved, and never do anything unsafe. You do any activity at your own risk. We ask about your limits so we can tailor cards, but we can’t assure that a card suits your circumstances.
Excluded damages. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits or lost data, arising out of or relating to CardByMail or these terms.
Overall limit. To the fullest extent permitted by law, our total liability for any claim relating to CardByMail or these terms is limited to the amount you paid us in the 12 months before the claim arose.
What this does not limit. Nothing in these terms excludes or limits liability for fraud, gross negligence or willful misconduct, for death or personal injury caused by our negligence where the law does not allow that to be excluded, or for anything else that cannot be excluded or limited by law.
Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes about these terms or CardByMail are to be brought exclusively in the state and federal courts located in Orange County, Florida.
Changes to these terms
We may change these terms. When we do, we’ll update the “Last updated” date at the top of this page. The current version is always the one on this page.
